3. How We Process Takedown Notices

Upon receipt of a properly formatted DMCA takedown notice, we will:

  • Log the date and details of the notice.
  • Review the notice for completeness and validity.
  • If the notice appears to be valid and properly identifies the allegedly infringing material, we will take reasonable steps to remove or disable access to the specific material claimed to be infringing.
  • Where appropriate, we will attempt to notify the user who posted the content so that the user may respond.
  • We may retain a copy of the notice and related information for our records.

We will attempt to process notices promptly. In general, we will acknowledge receipt and act within a reasonable time frame (often within a few business days) but the exact timing may vary depending on the nature of the request and the information provided.

4. Counter-Notification Procedure (If You Believe a Takedown Was a Mistake)

If you receive a notice that your content has been removed or access to it has been disabled and you believe the removal was the result of error or misidentification, you may submit a counter-notification. Your counter-notification must include the following information (17 U.S.C. § 512(g)(3)):

  1. Your name, address, and email address (and telephone number, if available).
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed (for example, the exact URL).
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. A statement consenting to the jurisdiction of the federal district court in the judicial district in which your address is located (or, if you are outside the United States, a statement consenting to the jurisdiction of any judicial district in which PikaShows.it.com may be found) and that you will accept service of process from the person who provided the original DMCA takedown notice (or an agent of such person).
  5. Your physical or electronic signature.

After receiving a valid counter-notification, and if we determine the counter-notice meets the statutory requirements, we may restore the removed material within approximately 10–14 business days unless the copyright claimant provides notice that they have filed a court action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on our system or network.

5. Repeat Infringer Policy

We reserve the right to terminate access to or accounts of users who are determined to be repeat infringers in appropriate circumstances. This may include disabling access from particular IP addresses or removing accounts associated with repeated copyright violations. We may also take any other actions we deem appropriate under the circumstances.

6. Preservation Requests and Emergency Removal

If you need expedited action for an emergency (for example, where delay would cause irreparable harm), please state the reasons for urgency in your notice. We will evaluate such requests, but we are not required to follow emergency requests that do not comply with the statutory requirements.

7. Recordkeeping and Privacy

We may retain copies of takedown notices, counter-notifications, and related correspondence for recordkeeping and compliance purposes. We will handle personal information contained in notices in accordance with our Privacy Policy.
